Pretec CF Card Non-Infringement
U.S. District Court Rules in SanDisk Patent Case
Fremont, California, April 30th 2004 - In the case involving SanDisk Corporation (NASDAQ: SNDK) and Pretec Electronics Corporation, the United States District Court for the Northern District of California granted defendant Pretec's motion for summary judgment of non-infringement on April 20, 2004. In its order, the court found that the accused Pretec CompactFlashÔ (CF) memory cards did not infringe on SanDisk's patent, United States Patent No. 5,602,987 ("Flash EEPROM system", "'987 Patent").
In March 1998, SanDisk sued Lexar in the Northern District Court of California alleging that Lexar's CompactFlashÔ and PC Cards infringe SanDisk's '987 Patent, and in September 2000, a court order already obtained by SanDisk which holds that all of Lexar's current CompactFlash™ and PC cards contributorily infringe on a SanDisk "˜987 Patent. Subsequently SanDisk and Lexar has settled the patent disputes in November 2000, in which Lexar has stipulated that SanDisk's "˜987 Patent is valid and infringed by Lexar's current CompactFlashÔ and PC Cards (http://www.lexarmedia.com/dynamic-frameset_about.html?http://www.lexarmedia.com/newsroom/press_releases.html).
On October 20, 2001, SanDisk filed a complaint in the United States District Court for the Northern District of California against Memorex and Pretec Electronics Corp., alleging infringement of '987 Patent, SanDisk seeks to stop the defendants from making, selling or offering for sale products pertaining to the configuration technology in "˜987 Patent issued on February 11, 1997. Pretec has denied the claims brought against it and has defended vigorously to its conclusion.
